Family Medical Leave Act

The Family and Medical Leave Act (FMLA) of 1993 provides up to 12 weeks, in any 12 months, of unpaid, job-protected leave to eligible employees for the birth or adoption of a new child, for an employee’s own serious medical condition, or to provide care for a family member (child, spouse or parent) with a serious medical condition. Effective January 28, 2008, a new provision was added to the FMLA titled “Servicemember Family Leave.”  This provision allows an eligible employee who is the spouse, child, parent or “next of kin” of a “covered service member” to take up to 26 weeks of leave in a single 12- month period to care for the service member; this provision applies to eligible service members as well. FMLA can be taken on a continuous, intermittent or reduced schedule basis.
